Terms of Service

Document Type Binding User Agreement

These Terms of Service (the "Terms") govern access to and use of ALTIVOR INSTITUTE altivor.institute (the "Platform"). The Platform provides educational services, training programmes, and tools designed to support the development of skills in trading and risk management. By accessing or using the Platform, the User confirms that they have read, understood, and accepted these Terms in their entirety. If you do not accept these Terms, you must discontinue your use of the Platform immediately.

Section 01
Platform Operator

The Platform is operated by:

Section 02
Definitions
Operator The entity operating the Platform ALTIVOR INSTITUTE.
User Any individual accessing or using the Platform.
Services All features, products, and content available on the Platform.
Account An individual user profile granting access to Platform Services.
Challenge An educational training or evaluation programme assessing discipline, process adherence, and skill development.
Dashboard The user control panel for monitoring progress, performance data, and account information.
Educational Materials Courses, articles, recordings, frameworks, and tools provided by the Platform for educational purposes.
Section 03
Nature of Services

All Services provided by ALTIVOR INSTITUTE are exclusively educational, instructional, and operational in nature. The Platform does not constitute and should not be construed as a financial services provider. Specifically, ALTIVOR INSTITUTE:

  • Is not a broker or financial intermediary
  • Does not provide investment services or advisory services
  • Does not manage user funds or capital
  • Does not maintain investment or trading accounts on behalf of users
  • Does not provide individual investment recommendations or personalised financial advice

All information and content published on the Platform is of a general, educational, and informational nature only.

Section 04
No Guarantee of Results

Trading financial instruments involves significant financial risk. Access to and use of the Platform's educational materials, training programmes, and tools does not constitute a guarantee of financial gain or trading success. Specifically:

  • Past performance whether of a strategy, framework, or programme does not guarantee future results
  • Completion of any Challenge or training programme does not ensure profitability in live trading
  • All investment and trading decisions are made solely by the User, at their own risk and on their own account

The User acknowledges that the use of educational content cannot eliminate the inherent risks of trading and assumes full responsibility for any financial outcomes resulting from their trading activity.

Section 05
Conditions of Use

Access to and use of the Platform is subject to the following conditions:

  • The User must be at least 18 years of age
  • The User must provide accurate, complete, and truthful information when required
  • The User must comply with all applicable laws and regulations in their jurisdiction
  • The User must not use the Platform for any unlawful, fraudulent, or harmful purpose
  • The User must not interfere with or disrupt the operation of the Platform or its infrastructure

The Operator reserves the right to verify compliance with these conditions and to restrict access where a breach is identified or suspected.

Section 06
User Account

Certain features and Services may require the creation of a user Account. With respect to their Account, the User:

  • Is solely responsible for maintaining the confidentiality of their login credentials
  • Is solely responsible for all activity conducted through their Account
  • Must notify the Operator promptly of any suspected unauthorised access or security breach

The Operator reserves the right to suspend or permanently delete an Account without prior notice in the event of a material breach of these Terms, misuse of the Platform, or any activity that may harm the Platform, its users, or third parties.

Section 07
Challenge & Training Programmes

Challenges and training programmes offered by ALTIVOR INSTITUTE are exclusively educational in character and are designed to assess the User's trading discipline, process consistency, and skill development. The following conditions apply:

  • Results achieved within a Challenge do not constitute actual investment results
  • Challenge outcomes are not indicative of future live trading performance
  • Challenge data may be based on simulated or hypothetical market conditions

Unless expressly and separately agreed in writing, the Operator is under no obligation to provide rewards, funding arrangements, capital allocation, or any form of commercial partnership in connection with the completion of any Challenge or programme.

Section 08
Dashboard & User Data

The Platform's Dashboard allows Users to enter, store, and analyse personal trading data. The following conditions apply:

  • Data entered by the User is used exclusively to support the educational and analytical functions of the Platform
  • The Operator accepts no responsibility for the accuracy, completeness, or correctness of data entered by the User
  • User-entered data is not made publicly accessible without the explicit consent of the User
Section 09
Fees & Payments

Certain Services on the Platform may be subject to payment. The following conditions apply to all paid Services:

  • Payments are processed through authorised third-party payment service providers
  • Prices are denominated in the currency specified on the Platform at the time of purchase
  • Access to paid Services may be time-limited as indicated at the point of purchase
  • The Operator reserves the right to amend pricing with reasonable notice
Section 10
Right of Withdrawal

Where a User qualifies as a consumer under applicable law, they may have a statutory right to withdraw from a distance contract within 14 calendar days of entering into the agreement, subject to the following:

  • The right of withdrawal does not apply where the User has expressly requested and consented to the immediate commencement of the provision of digital content or services prior to the expiry of the withdrawal period
  • Where the User provides such express consent, they acknowledge that they forfeit their right of withdrawal upon commencement of the service

Section 11
Intellectual Property

All content available on the Platform including but not limited to text, graphics, frameworks, methodologies, tools, software, data, and audiovisual materials is protected by applicable intellectual property law and remains the exclusive property of ALTIVOR INSTITUTE or its licensors. Without the prior written consent of the Operator, the following are strictly prohibited:

  • Reproduction or copying of Platform content in whole or in part
  • Distribution, publication, or transmission of Platform content to third parties
  • Modification, adaptation, or creation of derivative works
  • Commercial exploitation of any Platform content

Unauthorised use of Platform content may give rise to civil and criminal liability under applicable law.

Section 12
Limitation of Liability

To the fullest extent permitted by applicable law, the Operator accepts no liability for:

  • Investment or trading decisions made by the User
  • Financial losses of any nature sustained by the User
  • Interruptions, outages, or disruptions to the Platform
  • Acts or omissions of third parties
  • Losses arising from the improper, negligent, or unauthorised use of Platform Services

Where liability cannot be excluded by law, the Operator's aggregate liability to any User shall not exceed the total amount paid by that User for the relevant Service giving rise to the claim.

Section 13
Prohibited Conduct

The following conduct is expressly prohibited on the Platform:

  • Attempting to gain unauthorised access to any system, server, or database
  • Circumventing, disabling, or bypassing security or access controls
  • Automated scraping, harvesting, or extraction of Platform data
  • Using the Platform to transmit unsolicited commercial communications (spam)
  • Impersonating any person or entity, or misrepresenting affiliation
  • Uploading or transmitting malicious code, viruses, or harmful content
  • Any conduct that disrupts, degrades, or compromises the integrity of the Platform

Violations may result in immediate Account suspension, permanent termination, and referral to relevant law enforcement authorities.

Section 14
Suspension or Termination of Services

The Operator reserves the right, at its sole discretion and with or without prior notice, to:

  • Modify, restrict, or expand the scope of any Service
  • Temporarily suspend Platform features for maintenance or technical reasons
  • Permanently discontinue the provision of any or all Services

Where Services are terminated for reasons attributable solely to the Operator, the Operator will endeavour to provide reasonable advance notice where practicable.

Section 15
Data Protection

The collection, processing, and use of personal data in connection with the Platform is governed exclusively by the Privacy Policy, which forms an integral part of these Terms and is available at all times on the Platform. By accepting these Terms, the User also acknowledges the Privacy Policy.

Section 16
Amendments

The Operator reserves the right to amend these Terms at any time. The current and binding version of the Terms will be published on the Platform at all times. Users will be notified of material amendments through appropriate channels. Continued use of the Platform following the publication of any amendment constitutes acceptance of the revised Terms.

Section 17
Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the European Union and applicable national legislation. Any disputes arising from or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of the Operator's place of establishment.

Where a User qualifies as a consumer, nothing in these Terms shall operate to deprive that User of any mandatory rights afforded to them under the consumer protection laws of their country of habitual residence.

Section 18
Copyright & Intellectual Property Rights

All content made available on the Platform — including, without limitation, text, educational materials, trading frameworks, methodologies, tools, software, databases, graphics, user interfaces, branding elements, trademarks, and audiovisual materials (collectively, the “Content”) — constitutes intellectual property protected under applicable law and is owned exclusively by ALTIVOR INSTITUTE or its licensors.

The Content is protected under copyright law, database protection law, industrial property law, and applicable unfair competition regulations. Such protection applies irrespective of the form, medium, or technology through which the Content is made available.

No ownership rights are transferred to the User. The User is granted a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Content solely for personal, non-commercial, educational purposes, strictly in accordance with these Terms.

EU & Polish Law Compliance

In accordance with applicable European Union legislation, including Directive 2001/29/EC (InfoSoc Directive), Directive (EU) 2019/790 (DSM Directive), and the Polish Act on Copyright and Related Rights (Ustawa o prawie autorskim i prawach pokrewnych), all rights to the Content arise upon creation and remain vested in the Operator or its licensors.

The scope of protection includes, without limitation:

  • Economic rights, including reproduction, distribution, public communication, making available, and adaptation
  • Moral rights, including authorship attribution and protection of the integrity of the Content
  • Sui generis database rights, where applicable

Any use of the Content exceeding the scope expressly permitted under these Terms requires prior, explicit, written consent of the Operator, unless such use is permitted under mandatory provisions of applicable law (including statutory exceptions and limitations).

Nothing in these Terms shall be construed as restricting any rights granted to Users under mandatory consumer protection laws or statutory exceptions to copyright under applicable law.

Prohibited Use

Without prejudice to the foregoing, the User shall not, without prior written consent of the Operator:

  • Copy, reproduce, or store the Content outside normal Platform use
  • Distribute, publish, transmit, or otherwise make the Content available to third parties
  • Modify, adapt, translate, or create derivative works
  • Use the Content for commercial, competitive, or resale purposes
  • Extract or reutilise substantial parts of any database
  • Reverse engineer, decompile, or attempt to derive source code where applicable

Enforcement & Consequences of Infringement

Any unauthorised use of the Content may constitute an infringement of intellectual property rights and may result in legal consequences under applicable law.

Subject to applicable legal requirements, the Operator reserves the right to take appropriate action in response to infringement, including:

  • Requesting cessation of the infringing activity
  • Removal or disabling access to infringing content
  • Suspension or termination of the User’s Account
  • Seeking injunctive relief where available
  • Pursuing claims for damages or compensation, where justified under applicable law
  • Seeking recovery of unjust enrichment, where applicable

The Operator shall exercise such rights in a manner consistent with applicable law, including proportionality requirements and User rights.

International Scope

The Content is protected internationally under applicable treaties, including the Berne Convention for the Protection of Literary and Artistic Works and the TRIPS Agreement.

Users acknowledge that unauthorised use of the Content may have cross-border legal implications and may be subject to enforcement in jurisdictions where such use produces legal effects, subject to applicable laws and procedural requirements.

Regulatory Clarification

Nothing in this Section shall be interpreted as extending the scope of the Platform’s Services beyond their educational nature, nor as creating any form of regulated financial service, investment service, or advisory activity.
